Malheur (Bundy) Militia Dug Latrine Trenches Among Sacred Artefacts*

On Tuesday, U.S. Attorney Billy Williams released a report in district court which provides the first description of the condition of the Malheur Wildlife Refuge, a site sacred to the Burns Paiute Tribe after a 41-day armed standoff with militants led by Ammon Bundy.

Disturbingly, Williams writes,

“Occupiers appear to have excavated two large trenches and an improvised road on or adjacent to grounds containing sensitive artefacts. At least one of these trenches contains human faeces.”

The refuge was once part of the 1.8 million acre Malheur Indian reservation which belonged to several Northern Paiute bands including the nearby Burns Paiute tribe. The buildings the militants occupied demanding the “return” of federal lands to ranchers, miners and loggers contained over 4,000 artefacts and maps of graves and other culturally significant sites on the refuge.

“That whole area is an artifact area,” Jarvis Kennedy, Burns Paiute tribal council member told ICTMN,

“If you just walk across there you’ll see chips on the ground where someone made an arrowhead. It’s everywhere.”

When asked what he thought of the latrines Kennedy said,

“Just see this…this is their mindset—not really caring about anything. For them to do that in that area is so disgusting.”

He doesn’t think the militants weren’t simply clueless either,

“I think they didn’t care. We did our press conference. We took our stand. They knew.”

The FBI’s Art Crimes Team is handling the investigation of these culturally-sensitive sites. General evidence gathering began on Saturday and the FBI estimates it will take 21 days to process the entire crime scene.

“We want to ensure our archaeology department is involved in the investigation,” Burns Paiute tribal chairwoman Charlotte Roderique insists,

“Praying there hasn’t been too much damage, but definitely concerned about the disturbance of any remains or anything like that. Because this the cruellest thing anyone can do.”

“Still,” Roderique adds,

“So thankful for all the Native nations—all the groups out there that supported us through this whole thing. Knowing that other people cared has meant a lot. Knowing here are people out there who can understand our situation, our concern about our ancestors’ remains. Even tribes that have their own issues going on regarding archaeology of the land and ARPA cases that are out there.”

She had received letters of support not only from tribes across the country but from as far away as Peru and from remote Russian communities.

The tribe, itself, will be holding a day of spiritual prayers to cleanse the land. They will send out a notification via tribal newspapers and by word of mouth for others to come and pray with the Paiute people. “We want to cleanse the land,” Roderique says, “and not disturb animal life or the spirits of our people.”

She noted how the occupation has brought her tribe together and even members of the community who have historically been at odds with the tribe.

“At one of the town meetings, right at the beginning, one of the gentlemen who owns a big ranching outfit addressed the meeting and said that his family had been ranching for 5 generations in this area. The first generation was wiped out by fires during the Bannock War, but he said, ‘We’ve worked, we sit at the table with tribal people and make decisions on fish and wildlife and the environment and way to control noxious weeds and I have no animosity toward the tribe.’ I think we all have gotten past the ‘I hate white people/I hate Indians’ interaction.

However, she has received threatening letters, emails and texts from Bundy supporters which she immediately forwards to the FBI.

“If it has a Colorado prefix,” Roderique says, “ I can be sure it’s one of the militia people here on their cell phone.”

Although, no one in the tribe is happy with the late militant spokesman LaVoy Finicum’s death after he ran a police blockade and charged police while armed they do wonder if it is tied to his handling of their artefacts in the Youtube video he put out criticizing the way the tribe’s artefacts were stored.

“He [Finicum} had the bag of flints he was waving them and the next day he is dead,” Roderique told ICTMN.

“He should never have picked those up and disturbed those spirits who made them. If it is flint arrowheads, someone who was a warrior or was a good hunter—those are the kind who can come back and do these things.”

Her son has been working on archaeological digs for over 20 years and he always purifies himself before and after.

“When you are at a site and going to be looking for our ancestors’ possessions and taking pictures of them you need to prepare yourself. You need to cleanse yourself. Some people say they have bad dreams and talk in their sleep. Tribal people always prepare themselves.”

Ammon Bundy continues to ignore the Burns Paiute tribe’s connection to land which was never ceded in any treaty to the United States. In custody since January 26, he released a statement on Friday through his lawyer saying,

“This land belongs to the people. We must get our government in control and back to benefiting the people.”

His father Cliven Bundy, the Nevada rancher who held a standoff in 2014 against federal agents for refusing to pay copy million in grazing fees owed to the Bureau of Land Management, was arrested a week ago at the Portland airport attempting to join the occupation at Malheur and rally support of the last holdouts. He was denied bail on Tuesday due to being a flight risk and for “lawless and violent” behaviour.

Assistant U.S. Attorney Steven W. Myhre in a memo seeking Cliven Bundy’s pre-trial detention quoted a Bundy Ranch Facebook post from February 10 that announced Cliven was headed to Oregon and read in part: “WAKE UP PATRIOTS! WAKE UP MILITIA! IT’S TIME!!!!!”

“When he uses the term militia, he’s talking about guns,” Myhre said.

Michelle Fiore, Nevada assemblywoman and Bundy supporter who over a live-streamed phone conversation convinced the last holdouts to leave the refuge, took issue with the description of the Bundy family’s armed resistance as violent.

“This was a bunch of cowboys camping out in the middle of nowhere,” Fiore claimed,

“They were exercising their constitutional rights to assemble, to free speech: their right to bear arms.”

In an unprecedented international decision, the UN has ruled that abortion is a human right.
Though it several years for the UN to make the decision and over a decade for Peru to comply, a young woman from Peru is finally being paid reparations for not being allowed to abort her unborn child.

It all started in 2001, when a 17-year-old woman called K.L. was three months pregnant and her unborn child was diagnosed with anencephaly. This birth defect means that the foetus was developing with little to no forebrain and, if carried to term, the baby would certainly die and would risk the mother’s health as well. The doctor that made the diagnosis recommended that K.L. have an abortion since Peru allows abortion when the life of the mother is at risk.

Despite this exception to the otherwise outlawed practice of abortion, the hospital refused to perform the procedure on the grounds that the State did not provide clear regulations for providing the service. The 17-year-old woman was forced to give birth to her child and then breast feed her for the four days that she survived outside of the womb. K.L. described the remainder of her pregnancy as an “extended funeral” and, after seeing the deformities on her baby and knowing she would not live very long, she sank into a deep depression from which it took years to recover. 

The Centre for Reproductive rights said that the Peruvian hospital illegally denied her right to an abortion and when they learned of the case several months after the baby died in 2002, they took the case to the United Nations Human Rights Council and filed it against the Peruvian government.

It was not until 2005 that the UNHRC declared that Peru, in denying K.L. a legal medical procedure that had a plethora of adverse and long-lasting effects, had violated several articles of the International Covenant on Civil and Political Rights. The violations included the right to an effective remedy, prohibition on torture and cruel, inhuman, and degrading treatment, the right to private life, and the right of minors to measures of protections.

The decision marked the first time that an international human rights committee had ruled that a government body was accountable for not allowing access to legal abortion services, according to the Center for Reproductive Rights. The UNHRC also demanded that Peru pay reparations to the woman to make up for the mental and physical consequences she faced. Peru did not, however, immediately agree to pay the reparations.

Lilian Sepúlveda, one of the original attorneys K.L. v. Peru who brought the case to the U.N., said that,

““As groundbreaking as this win was for establishing legal precedent, successes like these do not stand on their own. In order to make a difference for our client and women facing similar situations, concrete implementation of the decision is absolutely essential.”

The implementation that Sepúlveda references began in 2014 in Peru. Almost a decade after the U.N. made their decision, Peru adopted national guidelines for safe abortion practices and gave clarity to physicians and patients. The country also finally met with the Centre for Reproductive Rights to negotiate a reparation agreement for K.L., which was paid in December of 2015.

According to Women on Web, 25% of the world’s population lives where there are highly restrictive abortion laws that essentially make a safe abortion illegal. About 13% of maternal deaths worldwide were caused from unsafe abortion practices. 95% of abortions in Latin America and over 97% of abortions in Africa were unsafe in 2008. It is especially important to consider the legality and morality of abortion right now in Latin America because of the rise of Zika virus, where babies are born with small heads and underdeveloped brains. Though the origins of the virus may be highly controversial, the fact that there has been an increase in babies born with this defect is not and should be considered in the debate.

In what could be a story straight out of the Onion, but sadly played out in reality, a Texas man was arrested by seven heavily armed U.S. Marshals for failing to pay an almost 30-year-old student loan debt. The man, Paul Aker, 48, said he was caught off-guard by the heavily armed agents that showed up at his home to arrest him for failing to pay the nearly 3-decades old debt

““They grabbed me, they threw me down,” Aker told the Daily News on Tuesday. “Local PD is just standing there.”

According to a report by the NY Daily News

“He said he noticed a suspicious truck in front of his house on Thursday morning, and when someone approached, he ran back into the house. Later that morning, a bunch of armed Marshals with combat weapons showed up at his door.

“I say, ‘What is this all about?’” Aker told The News.

“They say, ‘Shut up, you know what this is all about.’ I don’t have a clue.”

When Aker continued to ask, they continued to say “you know what this is all about,” he said.

Eventually he was told it was about a 30-year-old student loan.

“You could have sent me a letter. You could have called me,” Aker said.

The U.S. Marshals said later in court that they had the firepower because Aker had a gun, but he disputes that.

“But you were already at my door,” he said.

“It was because they knew I was a registered gun owner.

“It’s out of control. Out of control,” he continued. What if they had seen a gun on me? They would have shot me for 1,500 bucks.”

Aker’s arrest for a 30-year-old, $1,500 dollar debt is disturbing enough; but taken in concert with the fact that simply being an owner of a firearm, a protected right under the U.S. Constitution, was reason enough for agents to arrive in combat gear and with fully automatic weapons raises the ominous spectre of the police state rising. After being arrested, Aker was held at the federal building in downtown Houston, before being brought to a courtroom, where a “prosecutor,” judge and county clerk were present, according to the NY Daily News. Aker said the alleged “prosecutor” was really a collection lawyer.

““Then I get a lecture (from the judge) about the United States and stealing from the government,” Aker said”
Aker told The News that he was ordered to pay $5,700 for the loan, including interest. However, Aker was also ordered to pay for the cost of the morning arrest — nearly $1,300. If he didn’t pay that amount by March 1, he said, he was told he would be arrested again

Aker was shaken by the entire ordeal and is working to secure legal representation. He claims that during the whole process he was never read his rights

“I am still shaken,” Aker said.

“I had to go to work yesterday, and it was hard to drive to work, for the fear of someone coming. I am looking out the window and I have things to do today, and I am still afraid to go outside.”
The average student loan debt for a 2015 graduate was approximately $35,000, according to the Wall Street Journal. The criminalization of those who can’t afford to repay a student loan may become a more common phenomenon, with a report by Fox 26 claiming that U.S. Marshals have plans to serve up to 1,500 warrants on people who have failed to repay their student loans.

Texas Rep. Gene Green (D) sees a problem with using U.S. Marshals to act as muscle to collect these loans for debt collectors and lawyers

““There’s bound to be a better way to collect on a student loan debt that is so old,” Green told Fox 26”

According to a report by Fox 26

Congressman Gene Green says the federal government is now using private debt collectors to go after those who owe student loans. Green says as a result, those attorneys and debt collectors are getting judgements in federal court and asking judges to use the U.S. Marshals Service to arrest those who have failed to pay their federal student loans. Our reliable source with the U.S. Marshal in Houston say Aker isn’t the first and won’t be the last. They have to serve anywhere from 1200 to 1500 warrants to people who have failed to pay their federal student loans”

It is extremely worrisome that armed agents of the state are being used to bully people into paying delinquent student loan debt. There has to be a more intelligent manner in which to attempt to reconcile these debts than to send heavily armed men to arrest those either unwilling or more than likely unable to pay. It speaks to the nature of the state itself that the default position is virtually always one of coercive force rather than to intellectually assess the means that will most likely provide the desired result – a reconciled debt. When all you have is a hammer, everything begins to look like a nail

A dolphin died after it was taken out of the ocean so beachgoers could pose with it for selfies.

The small Franciscana dolphin quickly gained a crowd on the beach resort at Santa Teresita in Argentina after someone picked it up. It unfortunately overheated and died due to being out of the water.

The beachgoers continued to pass around the deceased dolphin and it was later discarded in the sand.

The La Plata dolphin, otherwise also known as the Franciscana is found off the coasts of Argentina, Brazil and Uruguay and is classed as a “vulnerable” species as there are an estimated 30,000 worldwide.

The Argentine Wildlife Foundation has issued a statement reminding the public of the mammal’s vulnerability in the hope it will prevent a repeat of this happening again in the future.

“The Franciscana, like other species, cannot remain for much time outside of the water, it has thick fatty skin which gives it heat and means that taking it out of the water rapidly causes it to dehydrate and die,” they said in a statement.

“This occasion serves to inform the public about the urgent necessity to return these dolphins to the sea as soon as possible if they find them on the shore.

“It is fundamental that people help to rescue these animals, because every Franciscana counts now.”

Let’s hope that this can serve as a reminder of how valuable life is, not just that of human beings and dolphins, but all species.

Conscious rapper Kendrick Lamar took his recent Grammy performance as an opportunity to raise awareness about mass incarceration. Lamar’s performance was artistic, powerful, and controversial — qualities many people have come to expect from the platinum-selling recording artist.

Before the event, host LL Cool J also hinted that Lamar’s performance was going to be thought-provoking.

“Kendrick Lamar is going to do something very controversial, and that’s what art is about. It’s not about whether you agree or disagree, it’s about it stimulating conversation and provoking people to have conversations about society,” LL Cool J said earlier this week.

Lamar’s performance certainly lived up to expectations, and it will surely spark conversation.

The performance began with Lamar walking out of the darkness in shackles, at the front of a prison chain gang. They all wore prison attire. He began with his poetic track, “Blacker the Berry,” and eventually transitioned into his newest hit, “Alright.” For the second portion of the performance, Lamar stood in front of a massive bonfire with tribal dancers situated all over the stage. Some of the most controversial lyrics in the song were omitted from the performance, including, “And we hate Popo, wanna kill us dead in the street for sure.”

This was likely a compromise to appease the Grammy’s censors and legal team, but the message was powerful nonetheless. Lamar closed the set with a unreleased and untitled track about death and “modern-day slavery.” As he walked off stage, a massive light screen in the shape of Africa was displayed on the wall. The word “Compton” was written inside.

In addition to his explosive performance, Lamar also walked home with five Grammy awards, including best hip hop album.

Russia’s Federal Security Service (FSB) reported today that it has arrested 14 suspects from an international criminal group involved in forging passports and other documents to send Islamists in Syria, and those coming to Russia for terror missions.

The FSB reported that a joint special FSB and Interior Ministry operation in the Moscow region has exposed an international organized crime network, which was providing forged papers for extremists from Russia and CIS countries.

The report also added that the members of the group were arrested after sufficient evidence had been gathered including a vast stockpile of forged documents, forms, stamps, special equipment for fake papers’ production and extremist literature.

According to the FSB reports, the gang was busy forging documents for those

“illegally heading to Syria to take part in military actions on the side of Islamic State, and also for the militants sent on a mission to Russia by ISIS leaders to conduct terrorist and extremist activities, as well as illegal migrants.”

The FSB report said that the members of the criminal group have been taking extreme precautionary measures by constantly changing their place of residence and using undercover communications’ tools, including software which enable them to hide personal data while surfing the web.
